Steve Udick

Associate

Steve Udick practices complex commercial and IP litigation, with a particular focus on patent, trade secret, and appellate law. Steve’s litigation experience involves a diverse group of clients from the Fortune 10 to privately held companies, including clients in the pharmaceutical, medical device, computer hardware and software, and financial investment industries.

Steve has obtained uncommon experience in his early career, arguing in federal court, handling case preparation, discovery, taking and defending fact witness depositions, prepared expert witnesses and defended expert depositions, prepared claim construction, dispositive, and trial briefs, and handled trial preparation, trial, and appellate matters.

Prior to joining Skiermont Derby LLP, Steve was an IP litigation associate at Akin Gump Strauss Hauer & Feld LLP, in Dallas. Before entering the practice of law, Steve worked in technology sales and consulting roles, which took advantage of his ability to convincingly convey complex technical ideas to non-technical audiences.

Representing HRA Pharma, the branded pharmaceutical developer of ella®, in paragraph IV Hatch-Waxman patent litigation against ANDA applicant.

Andrulis Pharmaceuticals Corp. v. Celgene Corp. (District of Delaware)

Representing plaintiff pharmaceutical company in patent litigation pertaining to the use of thalidomide in combination with an alkylating agent to treat certain cancers.

 

LoggerHead Tools, LLC, v. Sears Holding Corp. and Apex Tool Group, LLC (Northern District of Illinois)

Represent patent owner against Sears and Apex in a lawsuit alleging patent infringement, trademark infringement, and tort claims arising from Sears’ sales of Craftsman Max Axess Locking Wrenches. LoggerHead CEO, Dan Brown, is the inventor of the Bionic Wrench®.

At a former law firm, defended a major telecommunications provider at trial in patent infringement litigation regarding secured network transmission protocols.

At a former law firm, defended a leading computer hardware and software company against claims related to display orientation technologies.

Representing appellant pharmaceutical company in appeal arising out of adverse claim construction rulings at the district court.

Wi-Fi One, LLC (formerly Ericsson) v. Broadcom Corporation (Federal Circuit)

Representing appellant in appeal arising out of adverse rulings before the Patent Trial and Appeal Board in an inter partes review brought by Broadcom Corporation.

In re Nintendo Co., Ltd (Federal Circuit)

Representing amicus curae in support of petitioner Nintendo seeking writ of mandamus from a district court’s order regarding joinder of defendants in a patent infringement action.

 

Conducted strategic review of patent portfolios to determine licensing and assertion strategies, as well as advise on on-going prosecution strategies.

At a former law firm, advised a major hedge fund client on the impact of ongoing patent litigation against an entity in which the client was heavily invested.

At a former law firm, conducted diligence review of IP portfolios for a complicated business transaction involving the sale of drilling equipment and related intellectual property.
